I have a friend who came to the United States without inspection. He didn't get caught. He has been married to a United States citizen woman for more than 10 years. Also, they have two children together. One of them is 3 years old and the other is one year old. he can apply, but he's probably in hot water with INS- if he watched the news lately- in the last year or so- they are deporting illegal immigrants- 10 years here- he may get a lifetime ban - seriously- contact a lawyer first.

if he crossed the country he must go back and get his legal status in his country, that usually takes up to 2 years, but considering that he has kids to cake care off, the judge may let him stay..
